The Delhi High Court on March 28 rejected a Public Interest Litigation (PIL) to remove Arvind Kejriwal -- who was arrested by Enforcement Directorate (ED) in the liquor policy case -- as Delhi CM.
The plea was moved by a person called Surjit Singh Yadav.
“While there might be practical difficulties, there is no scope for juridical interference or a legal bar. The executive branch can examine," said the High Court.
The plea stated that "Kejriwal continuing as the CM will not only lead to
obstruction of due process of law and disrupt the course of Justice, but
also would lead to breakdown of the constitutional machinery in the
State."
It further added that Kejriwal has 'virtually forfeited' his office as CM on account of being arrested and since he is in ED custody, he has disabled himself from performing the duties and responsibilities of being a public servant. "Constitutional morality, good governance and Constitutional trust arc the basic norms for holding a public office," the plea said.
Kejriwal is being produced before a city court today on the conclusion of his ED custodial remand. His wife on March 27 also claimed that no money was found in multiple raids conducted by the central probe agency in the liquor policy case.
Kejriwal’s wife Sunita, in a digital briefing said her husband will reveal the details of the liquor policy case in court on March 28 and also present evidence.
