The Delhi High Court on May 22 allowed BharatPe co-founder Ashneer Grover, his wife, Madhuri Jain Grover, a former HR director at the payments firm to travel to the United States of America (USA) separately for their children's summer school.
Justice Subramonium Prasad, who heard the case indicated that he will pass a detailed order on May 24 once the Economic Offences Wing (EOW) comes back with the conditions for the couple to travel abroad.
As per what transpired in the court Grover will travel to the USA on May 26 and return to India on June 14. Jain will travel on June 15 and return on July 1. During the course of the hearing, the court urged the EOW to be reasonable with such requests and not contest it unless there is a clear apprehension of flight risk.
Earlier, the EoW objected to the plea, saying the couple had properties abroad and were a flight risk. The investigation against them was at an advanced and a crucial stage, it said. The couple, especially Madhuri was not cooperating in the investigation. EOW had also claimed that they had found suspicious transactions worth crores.
However, today, Grover's lawyer Giriraj Subramanium pointed out that the duo have cooperated with the EOW to the best of their capacity. According to Subramanium, Grover attended the enquiry once while Jain attended it twice.
Grover and Jain cannot leave the country without obtaining a court’s permission as a Look Out Circular (LOC) has been issued against them on the request of the EOW.
Ashneer and Madhuri are accused of committing a Rs 81-crore fraud at the fintech firm.
An LOC is usually issued against persons who have a criminal record or are under investigation to prevent them from leaving the country where the alleged offence has been committed.
The ED, Central Bureau of Investigation, Directorate of Revenue Intelligence, Customs and Income Tax Department and the EOW are among the agencies which can request an LOC
