Airport fee petitioner may move court over DIAL levy

The Supreme Court’s ruling on not exempting Delhi from airport development fee (ADF) seems to spark off another spat.

The controversy reading ADF may not be over so soon sources tell CNBC-TV18 that Mumbai airport will be approaching the regulator to levy ADF while the petitioner maybe looking at filling a new case to help stop collection of ADF at the Delhi airport.

Consumer Online Foundation, an NGO which is the petitioner in the ADF case may move Delhi High Court over Delhi International Airport Ltd (DIAL) levy, reports CNBC-TV18's Mehak Kasbekar quoting sources. The SC on Tuesday had said that the private operator of India's busiest airport, Mumbai, will not be allowed to collect ADF, leaving out Delhi. However, in its ruling SC had granted liberty for appeal on DIAL levy. It is learnt that lawyers are examining SC order on DIAL. The DIAL fee was approved by Airports Economic Regulatory Authority (AERA) in April, 2010. However, AERA is examining the SC order on airport fees. Sources also add that Mumbai International Airport (MIAL) is contemplating to move AERA seeking nod for ADF levy. MIAL is likely to submit estimate of cost incurred for airport development and is confident of getting AERA approval in 10-14 days. Read details of the story here.
