The Telecom Commercial Communications Customer Preference Regulations, 2010 (Regulations) were revised with the introduction of the Telecom Commercial Communications Customer Preference (Twelfth Amendment) Regulations, 2013 (Amendment) dated 24 May 2013. The Amendment has been introduced to strengthen the regulatory framework relating to commercial communication from subscribers who indulge in telemarketing activities without registering themselves as telemarketers with the Telecom Regulatory Authority of India (TRAI). As per the Regulations, a subscriber is a person or legal entity who subscribes to a telecom service provided by an Access Provider and a telemarketer is a person or legal entity engaged in the activity of transmission of commercial communication.
