A woman judge was recently abused in a Delhi courtroom by a convict and his lawyer in connection with a six-year-old cheque bounce case.
“Tu hai kya cheez ………….ki tu bahar mil dekhte hai kaise zinda ghar jaati hai (who are you even? Meet us outside, and we will see how you return home alive),” the convict told the judge on April 2 as quoted by Indian Express.
The order was passed by Judicial Magistrate First Class (NI Act) Shivangi Mangla of Dwarka Court the same day.
According to a report by IE, the judge convicted the accused under Section 138 (dishonour of cheque) of the Negotiable Instruments Act.
Judge Mangla also said in her order that the accused held an object in his hand, which he tried to throw at her after she passed the conviction order.
According to the judge, the convict “erupted with anger” after hearing the judgment not in his favour. “He started harassing the judge in “unofficial Hindi language with commentary against the mother” of the judge,” she stated in her order as quoted by IE. “Then again they both (convict and counsel) harassed me mentally and physically to resign from my job and they both again harassed me to acquit the accused else they will file a complaint against me and forcibly arrange my resignation.”
The judge said appropriate action should be initiated against the convict before the National Commission for Women (NCW) for the threats and harassment. She also ordered a show cause notice to be issued to his counsel, Athul Kumar, to provide in writing the explanation for his conduct.
On April 5, the judge sentenced the convict to simple imprisonment for 22 months and directed him to pay a Rs 6.65 lakh fine in the cheque case.
