Japanese telecom firm NTT DoCoMo today said that Tatas raising "objections" to the enforcement of the London Court of Arbitration (LCIA) award directly contradicted its statements of intent to meet the payment obligations.
"The fact that Tata has raised objections to the enforcement of the London Court of Arbitration (LCIA) award directly contradicts its statements of intent to meet its payment obligations," DoCoMo said in a statement.
The award by the LCIA is internationally recognised, including by India, and there is no reason to delay, the Japanese firm added.
Sources close to Tata Sons said the company has filed an affidavit in the Delhi HC to resist enforcement of the award of LCIA tribunal.
Sources clarified that the company has been seeking cooperation of its partner DoCoMo in making appropriate representation to the government and the regulator to find a solution within the framework of the Indian law.
However, this cooperation has not been forthcoming and Tata Sons has become "extremely concerned" at DoCoMo's aggressive stance in the matter, sources close Tata Sons pointed out.
In June this year, Tata Sons was ordered to pay DoCoMo USD 1.17 billion in compensation for breaching an agreement pertaining to India joint venture Tata Teleservices.
The Japanese firm has filed a plea in the Delhi High Court seeking enforcement of the arbitration ruling.
Tata Sons has deposited the entire amount of USD 1.17 billion with the registrar of the Delhi High Court which is hearing the matter.
