The Delhi Police has registered an FIR against Kumar based on a formal complaint lodged by Swati Maliwal. In her complaint, Maliwal stated, “I tried calling Bibhav and Kejriwal both but I got no response. I went into the house of Kejriwal. I was told Kejriwal is inside the house and I was told to wait. "My shirt buttons opened and my shirt flew up he hit my head on the centre table. Then he kicked me on my chest, stomach and pelvis area. I told him I am having my periods, but he continued to assault me," Swati said, adding that she’s having difficulty in walking after the assault and her abdomen is in pain.

Three days after the incident, the Delhi Police went to Swati's residence where they recorded her statement in connection with the alleged assault. Her statement was recorded by a two-member team of police.
