The Maharashtra Real Estate Regulatory Authority (MahaRERA) has asked developers to include details of parking spaces allotted or sold to homebuyers in the sale agreement and allotment letter to prevent any ambiguity and future disputes.
The regulator said it was acting after receiving several complaints from homebuyers including building beams obstructing parking of vehicles, inability to park in the allotted slot, inability to open vehicle door to exit after parking, and inadequate manoeuvring space.
Consequently, the regulator decided to make it mandatory for developers to include all the details related to parking in annexures to the allotment letter and sale agreement.

The MahaRERA issued a model draft clause to be included in the legal documents by the developer. This will contain all details such as parking lot number, length, height and width of the parking space, and the location of parking slot offered to the homebuyer.
"This standard clause is to prevent any ambiguity or disputes at a later stage and is mandatory for promoter to annexe this with allotment letter and agreement for sale," MahaRERA said in a statement,
MahaRERA will insist on strict adherence to the circular and the standard draft clause. This will prevent any inconvenience and agony over parking that a homebuyer otherwise faces after moving in, the regulator said.

Case study
Homebuyers in Maharashtra can complain to the MahaRERA in case they have any problems with the parking space promised by the developer.
Moneycontrol reported in September 2023 that a homebuyer in Pune had approached the MahaRERA after the developer allegedly allotted a parking slot (mechanical parking) measuring 10 square metres against the promised 12 sq. m mentioned in the sale agreement. The homebuyer alleged that he was unable to park his SUV because of the smaller size of the mechanical parking slot.
The MahaRERA then directed Pune-based Naiknavare Developers to measure the parking space and deliver the slot to the homebuyer as promised in the sale agreement within a month.
