Apple takes CCI to Delhi High Court, challenges provision that penalises 'global turnover': Report

Apple has moved the Delhi High Court challenging provisions in India's competition law that allow it to impose penalties on 'global turnover', reported Bar & Bench.

The global tech giant has challenged the 2023 amendment to section 27(b) of the Competition Act, 2002, and the CCI (Determination of Monetary Penalty) Guidelines, 2024, according to the report.

The said provision allows the regulator to impose penalties up to 10% of the average of the turnover or income of the last three years for companies that have been found to be violating laws on dominant position.

The matter is listed before the division bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela for Wednesday, the report added.
