Apple has moved the Delhi High Court challenging provisions in India's competition law that allow it to impose penalties on 'global turnover', reported Bar & Bench.
The global tech giant has challenged the 2023 amendment to section 27(b) of the Competition Act, 2002, and the CCI (Determination of Monetary Penalty) Guidelines, 2024, according to the report.
The said provision allows the regulator to impose penalties up to 10% of the average of the turnover or income of the last three years for companies that have been found to be violating laws on dominant position.
The matter is listed before the division bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela for Wednesday, the report added.
The anti-trust regulator had sought a response from Apple to its probe report on abuse of dominant position and also asked the iPhone maker to share details of its financial statements from its India and global operations from 2022-2024, Business Standard had reported in September.
The anti-trust regulator had found Apple to be in violation of anti-competitive practices following an investigation into the app-store practices.
