A special 2G court will tomorrow consider ED's charge sheet filed against former Telecom Minister Dayanidhi Maran, his brother Kalanithi Maran and four others in the Aircel-Maxis deal related money laundering case.
ED, in its charge sheet filed before Special Judge O P Saini, named as accused the Maran brothers, Kalanithi's wife Kavery Maran and three others, including two companies.
Kapoor, 48, was appointed to the post by then owner Kalanithi Maran in November 2013. His abrupt resignation comes over a year before the expiry of his employment contract, SpiceJet sources said.
At present, SpiceJet has a fleet of at least 35 aircraft that includes Boeing 737s and Bombardier Q400s.
Additional Chief Metropolitan Magistrate Pritam Singh again issued summons to Maran, the firm and its then Managing Director S Natrajhen as the earlier summons were not served on the accused, who did not appear on Friday.
A similar order has also been issued for approaching division bench of the Madras High Court to challenge a single bench order on July 23 allowing the Sun Group companies to participate in the auction.
The Centre told Delhi High Court that the plea of Red FM, an associate company of Kalanithi Maran-promoted Sun TV Group, for security clearance to participate in the stage III of FM auctions is not maintainable as it is seeking judicial review of a policy decision.
The government has told the Delhi High Court that the security clearance to Kalanithi Maran-promoted Sun Group companies was denied keeping in mind "national security" concerns.
"The company, at that time, had also conveyed the non-executive position of the then promoter of the company. No outcome of such communication have been communicated to the company by the relevant authorities," the filing said.

On July 15, five companies of Kalanithi Maran-promoted Sun TV were not allowed to participate in Phase III FM auctions as the Information and Broadcasting Ministry had rejected their applications.

As it mulls its course of action, the Information and Broadcasting Ministry sought further details from the Home Ministry on the reasons for denial of security clearance to Sun TV Network channels so that it can justify its action if the matter reaches court.
Earlier last week, Attorney General Mukul Rohatgi had said that MHA‘s denial for security clearance to Kalanithi Maran-promoted Sun TV's 33 channels is incorrect. The MHA had denied security clearance on the basis of an ongoing probe against Maran by the Central Bureau of Investigation (CBI) and the and Enforcement Directorate (ED).
The I&B Ministry has sought the opinion in the binding nature of the Home Ministry's decision and if the case can be linked to economic offences and national security.
The Sun Network had already moved the Madras High Court seeking interim relief in the Sun FM matter and the court has granted it a stay till the petition is disposed of. It is expected to move the court again in the Sun TV Network issue.
The I&B Ministry has been informed about the decision of the Home Ministry, which was believed to have been influenced by pending criminal cases against Maran and his brother and former Union Minister Dayanidhi Maran, official sources said.

Shares of Sun TV Network fell more than 11 percent intraday Monday after the Enforcement Directorate issued an order to attach properties and assets belonging to Kalanithi and Dayanidhi Maran.
The move by Maran brothers came a month after the Supreme Court on February 9 had disallowed them from approaching Delhi High Court against the special court's order summoning them as accused in the case arising out of probe into the 2G spectrum allocation scam.
Special CBI judge O P Saini had on October 29 last year summoned these three and five others, including four firms, for tomorrow as accused after taking cognisance of the CBI's charge sheet filed in the case.
