HC stays order asking girl student to pay fine to college

New Delhi, Feb 21 (PTI) The Delhi High Court today stayed its single judge bench order asking a girl student to deposit a fine of Rs 1,000, imposed by a Delhi University college for allegedly indulging in malpractices in students' union polls. "We are staying the February 13 order of the single judge bench," a bench comprising Chief Justice D Murugesan and Justice V K Jain said. The court also issued notices to Delhi University and Bharti College at Janakpuri here on the plea of Kumari Kajal Garg, a final year student of B Com (H). Earlier, the single judge bench had asked the college to respond to the plea of the student that without any reasoned order, she was barred from attending classes for one month besides being asked to pay a fine of Rs 1,000 for allegedly indulging in electoral malpractices. Garg has alleged the punitive action was taken without serving her with the charge sheet and moreover, she was also accorded hearing by the disciplinary committee. The single judge bench first stayed the operation of the punitive action, but later asked the student to deposit the fine. An appeal was filed by the girl against the order. The division bench allowed the plea of Ashok Agarwal, the counsel for the student, and stayed the order asking her to pay the fine. The college had on January 2 decided to take disciplinary action against the student, who had filed nomination papers for the post of president of the students union, on the ground that she was found involved in "electoral mal-practice". The petition alleged the action was taken against her as she was vocal for students' rights. PTI SJK ZMN
