At least nine women were gang-raped at Murthal near Sonepat during last year's Jat agitation, the Punjab and Haryana High Court was told on Thursday by senior advocate Anupam Gupta who is assisting the court as amicus curiae.

The division bench of Justices Ajay Kumar Mittal and Amit Rawal was hearing the alleged mass rape case during the nine-day long Jat agitation for reservation in which at least 30 people were killed and hundreds injured last year.

Gupta claimed that he was informed about the nine victims by senior Haryana IAS officer Vijay Vardhan and there were call records to prove that.

Vardhan, however, has denied Gupta’s claim.

Gupta has again asked for handing over the case to CBI while he earlier accused the SIT of trying to wash its hands off the matter.

He also said the owner of Sukhdev Dhaba in Murthal — the alleged spot near the mass rape — had told the media about the rape while denying it in front of the SIT.

The special investigation team (SIT) set up by the Haryana government submitted its final report in July this year and said it had found no victim of the alleged mass rape. The High Court had ordered the SIT to also investigate the case and find the accused.

According to initial media reports, which the court also took notice of, at least 10 women had been gang-raped on February 22 by a group of nearly 40 Jat protesters near the Delhi-Ambala highway. Images of innerwear scattered on the fields were also doing the rounds.

When the reports of rape first emerged, the police had called it “false”. The Punjab and Haryana High Court in January this year said that the rape was indeed committed and the culprits needed to be booked.

Two witnesses - Bobby Joshi and Raj Kumar - had given their statements to the court, leading to the consequent observation by the division bench.

Raj Kumar said, as per an India Today report, that he had seen three or four boys dragging a girl by her hair and arms into the bushes near Sukhdev Dhaba while she shouted for help and all these happened in front of Kumar’s vehicle.

The first of the witnesses to speak out was a truck driver named Sukhwinder who claimed to have seen almost 50 women being taken to the farms by large group of men. But he also said he did not see what was being done to them, the ANI reported.

In April last year, the SIT team had submitted its report to the court and revealed that the police had finally included Section 376-D of IPC with charges of rape into the concerned FIR. The inclusion of gangrape charges were based on a complaint by eyewitness Bobby Joshi.

The first rape complaint was filed in February 2016 but the state government had initially denied the incident. However, the courts later pulled up the police over the incident.

Subsequently, a three-member committee of women police officers was constituted to receive complaints of sexual assault that might have taken place in Murthal during the agitations and violence. Clothes of the alleged victims were recovered from the spot and sent for forensic examination, as per media reports.
