Telecom companies can continue to breathe easy for another week. Telecom Disputes Settlement and Appellate Tribunal (TDSAT) heard Airtel , Vodafone and Idea 's petition on the 3G roaming pact for the first time. The DoT which had called this 3G roaming pact as illegal told the TDSAT it doesn't have the jurisdiction to hear this matter. BSNL the only co to have pan India 3G spectrum, filed an affidavit to become a co-respondent, reports CNBC-TV18's Malvika Jain.

The telecom tribunal has set Januray 9 as the next hearing date for 3G roaming pact case. The telecom companies had challenged DoT's  ban on inter-circle roaming agreement. DoT, however, had argued against the petition. In today's hearing at the tribunal it said that licensing issue does not come under its jurisdiction.

The next hearing will be only on January 9. Earlier, the TDSAT had passed an interim order directing DoT not to take any course of action against these five companies. So there is no ban on the 3G roaming services of these five operators atleast till Jan 9.

The telecom ministry had issued notices five telecom operators asking them to stop ICR for premium 3G mobile services as it was termed illegal and in violation of licence norms.
