The big patent battle between global pharma giant Roche and Indian generics major Cipla has started again. The hearings have resumed at the Delhi high court.

 

Roche alleged that Cipla has infringed on the patent for Roche's anti-cancer drug Tarceva. Presenting its case, Cipla denied any such infringement. Cipla's counsel Arun Jaitley argued that Tarceva is derived from a compound called polymorph-b, which is not yet patented in India. Hence, Rroche is marketing a product, which does not have marketing rights in India.

 

Cipla also claims that Roche had indulged in false and inadequate, patent disclosures. Cipla says since the process disclosures were not made at the time of filing for Indian patents, there is no question of copying the product.

 

But Roche maintains that 'Tarceva' has got patent validity in Iindia, and Cipla has violated it. The hearing continues today.
