SC allows Adanis to continue construction at Mundra SEZ

Ameet Desai, ED, Mundra Port and SEZ said that the petition was dismissed and the case will not continue in Gujarat High Court.
Excerpts from CNBC-TV18’s exclusive interview with Ameet Desai: Q: The Supreme Court order that has just come - is it a temporary relief or what exactly is the Supreme Court saying? A: The petition has been dismissed and has been withdrawn and therefore as far as our understanding goes, this petition doesn’t stand. Therefore the ex-party interim stay which was also granted, does not stay. In short, we hold petition stand dismissed and as withdrawn. Q: But does the case continue in the High Court? A: I don’t think so. When the petition, as I understand from my legal colleagues - when the court has said that the petition stands dismissed and as withdrawn, one can’t make a guess that the case continues in high court. Q: So no legal hassles at all for the SEZ? A: No, this was a temporary aberration and the Supreme Court has taken all the facts into consideration and as I understand from my colleagues in Delhi, we can confirm this petition has been dismissed as withdrawn. Q: From what we are hearing is that, the matter is now to be taken up in the Gujarat high court, you are saying that this matter is not going to continue in the Gujarat High Court and we got a clear chit for the time going ahead?
A: I am a little surprised to read this and my colleagues have confirmed to me that the petition stands dismissed and withdrawn and so therefore we cannot make a surmise that it will continue in High Court and as of now, this matter stands dismissed and therefore there is no matter against us in this case. Q: When the news came in of this petition being filed, and out of the 6,000 odd acres that you have been notified, you were asked to stop construction in those 6,000 acres now, you have a lot more acres under the SEZ which has been notified, so would the construction now continue for the entire area of the SEZ or only the permission has been given for 6,000 acres? A: To re-clarify the matter, if the petition stands dismissed, there is no operative order against the company and therefore the company will continue to do development work as planned, save for this temporary phase of 7-8 days which we had and therefore life goes on as usual from here onwards. |
