The oil ministry on Wednesday asserted before the Supreme Court that the government`s production-sharing contract with the Mukesh Ambani-led Reliance Industries Ltd (RIL) bars the company from private arrangements to supply gas.
"The government has exclusive rights over all minerals underlying the ocean and in the country`s territorial waters," Additional Solicitor General Mohan Parasaran, appearing for the oil ministry, told the three-member bench of the apex court.
"As per the production-sharing contract, the ownership of the gas cannot be passed on to RIL," Parasaran told the bench of Chief Justice K.G. Balakrishnan, Justice B. Sudershan Reddy and Justice P. Sathasivam.
"RIL cannot sell gas as it pleases," he said, while submitting his argument on behalf of the ministry of petroleum and natural gas, adding that the gas also cannot be reserved for any particular party in fixed quantities and tenure.
The court is hearing the dispute over the supply of 28 million units of gas for 17 years at $2.34 per unit to Anil Ambani-led Reliance Natural Resources Ltd (RNRL) from the gas fields off the Andhra Pradesh coast, awarded to RIL.
The price, tenure and quantity were based on a family re-organisation pact of 2005, but RIL subsequently said it could only sell the gas for $4.20 per unit, as this was the price, the company claimed, fixed by the government.
RNRL counsel Ram Jethmalani has already opposed the oil ministry`s plea to join the gas dispute as a party. He has also said if the oil ministry is granted its request, cross-examination of its officials must also be allowed.
Elaborating on the policy for gas, Parasaran said the RIL is supposed to supply gas to customers at a uniform arm`s length price, fixed on the basis of the formula evolved by the government that takes global prices into account.
The counsel said that in July 2006, the oil ministry had rejected RIL`s pact with RNRL for the supply of gas at $2.34 per unit. He also said the Bombay High Court`s ruling in favour of RNRL overrides the government`s executive authority

Just when the Berlin Wall was being broken down 20 years ago, the cricketing world started talking about a boy wonder who would rise to be a cricketing colossus. Two decades in sport is more than a generation and Sachin Tendulkar carries on and on--not wanting to think about the day he would have to stop playing the game.
Everyone who writes about cricket has to write about Tendulkar. The two are inseparable entities. It clearly underscores the fact that he is one of the greatest cricketers and in modern day parlance an entertainer par excellence with the highest TRP rating because he scores runs by tons with relentless brilliance.
Tendulkar`s greatest quality is--whatever he might say about his pre-match nervous energy--that he has an air of deliberate confidence before he goes in to bat that he is going to make runs. And make runs he did with regularity. This uncanny ability places him a cut above two of his contemporaries whose names are invariably taken in the same breath, Brian Lara and Ricky Ponting. But both admit that Tendulkar has something extra that makes him stand out.
The greatness of Tendulkar is that he spreads his skill through his teammates, lifting their morale and competence. Anyone who has played with him swears that he has benefited by his ability to transmit the knowledge about the game. Every player, who has shared with him the dressing room, struggles for words to describe the genius of the man. He is beyond their comprehension.
If ever a player has overshadowed him, for sheer class of batsmanship, it is V V S Laxman. After a record 353-run fourth-wicket partnership in the 2004 Sydney Test when Laxman hit 30 fours in his 178 to Tendulkar`s 33 in his unbeaten 241, the master put the artistry of V V S in perspective.

Shares of India`s biggest listed company Reliance Industries (RELI.BO: Quote, Profile, Research) are down since mid-June, compared with the rising benchmark index, in an unusual occurrence for a firm seen as a bellwether for the country`s stock market.
Investors have been worried about a gas-pricing dispute between the company, led by billionaire Mukesh Ambani, and Reliance Natural (RENR.BO: Quote, Profile, Research) that is controlled by his estranged younger brother Anil. The dispute is being heard by India`s top court. [ID:nBOM489932]
While an unfavourable ruling from a lower court in June has helped knock 11 percent of its market value to about $75 billion over the past five months, Reliance shares have jumped 15 percent over the past week on rumours of a settlement between the Ambani siblings even though the brothers have ruled out a patch-up.
Is the tide turning for investors in the refining, petrochemicals, and oil and gas exploration giant?

Market has a natural tendency to shake-off the non-believers and get rid of them before making any game changing move. If I have to gain in a market place, someone has to loose. It can not happen that every one is winner. So, it can not happen that everyone is riding the same bus when Unitech reaches say Rs 500. In times like these many people will fear that it might go down to Rs 40 and will sell-off and get out of bus. This is a necessary process, because everyone can not reach Rs 500 level (of Unitech). Only few firm believers might be able to ride it on it when it is at extremely low as well as extremely high level. I have purchased Unitech at Rs 36 and I am still holding it. When I will sell it, I will let you know. Till then, take a call. If you feel like, you may get off the bus and save your money & invest in FD/NSC. ...
