Zydus Cadila loses trademark case against Wallace

AHMEDABAD: The Rs 3,000-crore Zydus Group`s listed entity Cadila Healthcare lost a trademark against Goa-based Wallace Pharmaceuticals over the
latter`s use of the brand name Mexate. In the case that came up in the Gujarat High Court, Cadila objected to Wallace`s use of its trademark. Interestingly, both the companies have registered trademark for their respective trademarks.

While Cadila has been using the brand Mexate in its drug for cancer, rheumatoid arthritis and psoriasis which they got registered as trademark in the year 1994, Wallace has been using MEXT for curing similar ailments. Both the companies have coined their brand names on the basic ingredients. While Cadila derived its name Mexate from Methotraxate, Wallace adopted the trademark MEXT, derived from Methotrexate and Folic Acid.

As per Sec. 28(3) and 30(2) of the Trade Marks Act, 1999 one registered owner cannot file a suit for infringement of trademark against another registered owner. It was on these grounds that Cadila`s plea for action of infringement did not stand.

The order observed that since in the field of medicinal preparation it is a general practice to adopt the mark from the name of the drug itself, Cadila cannot claim monopoly over the mark which is an abbreviation of a basic drug.

Wallace Pharmaceuticals argued that it had applied for the mark as early as in 2002, and Cadila did not raise objection then. Subsequently, Wallace grew its brand and build a market for the product, besides regularly publishing its trademark in various medicinal journals and other magazines as well.

Wallace also supported its claim by producing sales figures from the year 2003 to 2007, which established the extensive use of trademark.

J V to introduce Swine flu vaccine

Cadila Pharmaceuticals Ltd announced a joint venture with US-based vaccine company Novavax Inc to, among other things, introduce in India a vaccine against swine flu.

The joint venture - CPL Biologicals Pvt Ltd - will be started with an initial investment of Rs 100 crore and will try to bring the vaccine, which is at an advanced stage of development in the US, to India in 2009-10.

Looking at the global spread of swine flu and the WHO declaring the flu a pandemic (H1N1 influenza), the joint venture could potentially market some 50 million doses of the vaccine annually in India.

At Rs 1,000 a shot, the market size could be Rs 5,000 crore in the country, said Rahul Singhvi, President and CEO, Novavax.

The joint venture of Cadila (80 per cent) and Novavax (20 per cent) was formed according to the agreement signed between the two companies in March. CPL Biologicals will work for development and manufacturing of therapeutic and prophylactic vaccines, biological therapeutics and diagnostics, the CPL Chairman, Indravadan A. Modi, told a press conference.

Besides swine flu vaccine, the joint venture would also work on the development of "novel, affordable vaccines" to prevent avian flu, cancer, SARS, chikungunya and more such diseases.

The Chairman of Novavax, John Lambert, and the Vice-President (Strategy), Thomas J. Johnston, were also present at the event.

Cadila Pharma is the largest shareholder of Novavax, a Nasdaq-listed, clinical stage biotechnology company, and has a position on the Novavax board.

Introducing Novavax`s "virus-like particles" (VLP) technology, that compresses vaccine manufacturing time and mimics the virus without the ability to cause infection, the joint venture intends to launch the swine flu vaccine soon, provided it receives approvals, as it was under phase-II clinical trials in the USA.

The vaccine would be first procured from Novavax before being manufactured in India, at the Dholka facility of Cadila Pharma.

Nearly three months after unveiling its potential blockbuster cardiac drug – Polycap, Ahmedabad-based Rs 800-crore Cadila Pharmaceuticals will soon come out with yet another promising drug that can bring down the cost for TB treatment by 33%.

The drug would hit the market over the next two weeks and promises to slash public healthcare costs significantly.

"The new drug, called Resorine, has been developed as a bio-enhancer that reduces the dosage of the existing drug administered to the tuberculosis patients, yet maintains the efficacy," Cadila chairman IA Modi told ET.
He further said that due to ‘Resorine’ the cost of tuberculosis treatment would get reduced by 30–33%, which according to him, will help developing countries like India that have a vast TB population. The company has completed phase III clinical trial over Resorine and also got USFDA’s approved protocol.

AHMEDABAD: Nearly three months after unveiling its potential blockbuster cardiac drug – Polycap, Ahmedabad-based Rs 800-crore Cadila Pharmaceuticals
will soon come out with yet another promising drug that can bring down the cost for TB treatment by 33%. The drug would hit the market over the next two weeks and promises to slash public healthcare costs significantly.

"The new drug, called Resorine, has been developed as a bio-enhancer that reduces the dosage of the existing drug administered to the tuberculosis patients, yet maintains the efficacy," Cadila chairman IA Modi told ET.
He further said that due to ‘Resorine’ the cost of tuberculosis treatment would get reduced by 30–33%, which according to him, will help developing countries like India that have a vast TB population. The company has completed phase III clinical trial over Resorine and also got USFDA’s approved protocol.

In a recent report, World Health Organisation (March 2008) says TB is a major cause of many illnesses and deaths worldwide. Globally, there were 92 lakh new cases and 17 lakh died due to TB in 2006. India alone is home to over 34 lakh tuberculosis patients and 3.25 lakh people in India died due to TB in 2005. As per WHO estimates, TB treatment costs run up to $3 billion every year.

Among the two keys drugs that go into the treatment of TB, Refampicin, is the costliest drug and needs to be administered in 450 ml dosage per day to the patient. Cadila that carried out bio-enhancement (altering the bio-ability) in its new drug has reduced the dosage of the Refampicin from 450 ml to up to 200 ml. Thus, by reducing the volume of the costlier drug in its new offering, the company has cut down on the costs. In the process, the company also claimed to have almost eliminated side-effects like liver toxicity, jaundice, flu-like-syndrome, vomiting and diarrohea.

Dr Naresh Patel, head of department of TB & chest diseases at Smt. NHL Municipal Medical College, Ahmedabad, told ET: "Resorine’s major advantage is that it enhances one of the key drugs that are used in the treatment of TB." Dr Patel is a pulmonology consultant who contributed to the research for Resorine.

Seeing a huge business potential, Cadila Pharma has already began production of Resorine and expects governments, the world over, to choose the new drug for bringing down healthcare cost around TB treatment.

It may be recalled that Cadila Pharma in March introduced Polycab, a 5-in-1 cardiac pill aimed at healthy people who are prone to heart ailment. Such a section of people includes smokers, diabetic, hypertensive and those with high levels of cholesterol. The drug was hailed by the international medical community as a major breakthrough and the research made it to renowned medical journal Lancet. The Ahmedabad-based major will commercially launch Polycap very soon.
